T&Cs (Terms and Conditions)

§ 1 Scope, Definitions

(1) Tannis Ausritte, Tannis Ausritte, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany (hereinafter: “we” or “Tannis Ausritte Shop”) operates an online shop under the website https://tannis-ausritte.de

(2) “Consumer” for the purposes of these terms and conditions is any natural person who concludes a legal transaction for purposes that predominantly are not attributable to their commercial or independent professional activity. “Entrepreneur” is a natural or legal person or a legally capable partnership acting in the exercise of their commercial or independent professional activity, whereby a legally capable partnership is a partnership with the capacity to acquire rights and incur liabilities.

§ 2 Conclusion of Contracts, Storage of Contract Text

(1) The following rules on the conclusion of contracts apply to orders via our online shop at https://tannis-ausritte.de

(2) Our product representations on the Internet are non-binding and do not constitute a binding offer to conclude a contract.

(3) Upon receipt of an order in our online shop, the following rules apply: The customer submits a binding offer by successfully completing the order procedure provided in our online shop. The order proceeds as follows:

1. Selection of the desired goods,
2. Adding products by clicking the corresponding button (e.g., “Add to Cart”),
3. Verification of the information in the shopping cart,
4. Accessing the order overview by clicking the appropriate button (e.g., “Proceed to Checkout”),
5. Input/check of address and contact details, selection of payment method, confirmation of T&Cs and withdrawal instructions,
6. Confirmation of any deviation from the usual quality or intended use of the goods, if applicable,
7. Completion of the order by clicking “Buy Now.” This constitutes your binding order.
8. The contract is concluded when a confirmation email is sent to the email address provided within three business days.

(4) In the event of contract conclusion, the contract is concluded with Tannis Ausritte, Tannis Ausritte, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany.

(5) Before placing an order, contract data can be printed or electronically saved via the browser. The order processing and transmission of all information required in connection with the conclusion of the contract, including order data, T&Cs, and withdrawal instructions, are sent by email after you place your order, partially automated. We do not store the contract text after conclusion.

(6) Input errors can be corrected using standard keyboard, mouse, or browser functions (e.g., “Back” button), or by aborting the order, closing the browser, and restarting the process.

(7) You must ensure that the email address provided is correct and that you can receive emails, particularly that messages are not blocked by spam filters.

§ 3 Subject of the Contract and Essential Features of the Products

(1) The subject of the contract in our online shop is:

1. Sale of goods. The specific offered goods can be found on the respective product pages.

(2) The essential characteristics of the goods are listed in the product description. Any deviation from usual characteristics or intended use (negative specification) is explicitly stated in the description. The contract is defined by your express consent to any such deviation.

§ 4 Prices, Shipping Costs, and Delivery

(1) All prices and shipping costs are total prices including all taxes.

(2) The purchase price must be paid before delivery (prepayment), unless otherwise stated. Available payment methods are shown in the online shop or the respective offer. Unless otherwise indicated, payment claims are due immediately.

(3) Additional shipping costs may apply if the item is not marked as free shipping. Shipping costs are clearly displayed in the offers, shopping cart, and order overview.

(4) All products are ready for shipment immediately, unless otherwise specified in the product description (delivery time: [insert default_delivery_time_text] after receipt of payment).

(5) Delivery is limited to the following countries: Belgium, Bulgaria, Germany, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary, Cyprus, Austria.

(6) If delivery fails for reasons attributable to you, you bear the resulting reasonable costs. This does not apply if you validly exercise your right of withdrawal. For return shipping costs in case of withdrawal, see our withdrawal instructions.

§ 5 Right of Retention

You may only exercise a right of retention if claims arise from the same contractual relationship.

§ 6 Right of Withdrawal

As a consumer, you have a right of withdrawal according to our withdrawal policy. Cancellation Instructions.

§ 7 Contract Language

The contract language is exclusively German.

§ 8 Liability

(1) Subject to the following exceptions, our liability for contractual breaches and torts is limited to intent or gross negligence.

(2) We are liable without limitation for slight negligence in cases of injury to life, body, health, or the breach of essential contractual obligations. For other damages caused by slight negligence, liability is limited to foreseeable, typical damages. Essential obligations are those that enable proper contract performance, whose violation endangers the contract purpose, and on which you regularly rely.

§ 9 Warranty

(1) Warranty is governed by statutory provisions.

(2) For entrepreneurs, the warranty period for delivered goods is 12 months.

(3) Consumers should check the goods, digital products, or services immediately upon receipt for completeness, obvious defects, or transport damage and report issues promptly. Failure to do so does not affect statutory warranty claims.

§ 10 Final Provisions / Dispute Resolution

(1) German law applies. For consumers, this applies only insofar as mandatory consumer protection law in the consumer’s country of residence is not restricted (principle of favorability).

(2) UN Sales Law does not apply.

(3) For merchants, legal entities under public law, or public special funds, the court of jurisdiction is the provider’s location.

(4) We are neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
